What are California Immigration Consultant Bonds?

Effective July 1, 2014, California Secretary of State increased the immigration consultant bond amount to $100,000. By posting a California immigration consultant surety bond, principals (consultants) pledge to conduct business in accordance with the provisions of Chapter 19.5 of Division 8 of the Business and Professions Code of the State of California. Prohibited acts under this bond include:

• Making false statements to a client while providing services
• Making a guarantee unless it is written and based on fact
• Making a statement indicating that the consultant can obtain special favors from the United States and Citizenship Services
• Charging a client a fee for a referral for services the consultant can't fulfill

This bond protects any individual or group of individuals who is harmed as a result of the principal's unlawful business practices. The surety will cover damages up to the full penal sum of the bond, and the principal must reimburse the surety for all damages paid out.

To become a licensed immigration consultant in California, applicants must submit the following items to the Secretary of State:

• Copy of a $100,000 surety bond
• Completed Immigration Consultant Disclosure form
• Copy of a valid and current photo identification
• 2” x 2” passport photo
• $30 filing fee
